Custody vs. Visitation - What's the difference?

Custody and Visitation are 2 different things.

What is the difference between custody and visitation?

As a family law firm in South Carolina, we understand that navigating divorce and child custody can be a difficult and complicated process. One of the most commonly misunderstood aspects of child custody is the difference between visitation and custody.

Custody

Custody refers to the legal rights and responsibilities of a parent in regards to their child. This includes decisions about the child's upbringing, education, healthcare, and religion. Custody is typically divided between two parents, either through joint custody or sole custody.

Visitation

Visitation, on the other hand, refers to the time each parent spends with their child. Visitation is typically granted to the non-custodial parent to ensure that they maintain a relationship with their child. Visitation schedules can vary and can be worked out between the parents or ordered by a judge.

Understanding the Difference

It's important to understand the difference between custody and visitation to ensure that your child's best interests are being met. Visitation does not entitle the non-custodial parent to make decisions about their child's life or interfere with the custodial parent's decisions.

If you're going through a divorce or separation and have questions about custody and visitation, you should seek the guidance of an experienced family law attorney. At Sarji Law, we're dedicated to helping families navigate the complexities of child custody and visitation and ensure that the best interests of the child are always prioritized.
